Hello! Welcome to the RoveTek UG (“we”) Terms of Use. 

These Terms of Use (“Terms”) are applied to all of our games, whether played on our website, mobile devices, PCs, or other platforms such as Facebook (together referred to as “Games”).

These Terms govern your access to and use of Games. It is displayed on the downloading platforms and on our official website.

Please read the Terms carefully before downloading and playing any Game.

By starting playing the Games, you automatically agree to these Terms and our Privacy Policy.

Services 

Games. We create Games that span a wide range of genres and appeal to the diverse interests and preferences of gamers around the world. Our team takes great care in creating each Game, paying close attention to details. You can find the specific rules and guidelines for each Game within the Game itself.

Platforms for downloading. We offer our Games to you on our website, other online platforms and as a standalone application that you may download via App Store, Google Play, etc. You can find the specific instructions for the downloading process in the terms of use of the respective online store. 

Price. Our Games are free to download and play. However, we do offer additional paid content within the Games, which is described in more detail in the “In-App Purchases” section of these Terms. 

Account

Creation. You can create an account by login to the Game with an existing Google, Apple, or Facebook account. You can play our Games without an account, but your game progress will not be saved.

Login credentials. When you create an account, we require you to select a unique username and password (“Login Credentials”). 

Security failure. You must notify us immediately if you become aware of any breach of security (any unauthorized account access or any loss, or theft) so we can take appropriate steps. 

You remain responsible for all losses on your account if you fail to keep your account or login credentials.

In-app purchases

Virtual items. In our Game, you may earn or purchase virtual currency, energy, resource boosters other virtual goods, and other in-app purchases that will help you to pass levels within our Games.

Capacity. If you purchase Virtual Items, you promise us that you are legally entitled to make such purchases.

Monetization. Virtual Items are not redeemable or refundable. Once you have purchased or earned Virtual Items you will not get the real money you paid back. 

Non-transferability. Virtual Items are personal to you and non-transferable. Only you can use Virtual Items and cannot permit anyone else to use them or trade them in any way.

Price. We indicate the Virtual Items price in the Games at the time of your purchase. We may change the price and specifications for any Virtual Items at any time for any reason. If you are resident of the European Union, the price includes any applicable value-added or similar sales tax.

Availability. We may limit the amount of Virtual Items you can purchase in a given period. Virtual Items may only be purchased and used by players in jurisdictions where such activities are permitted under applicable law. We may refuse any request to purchase Virtual Items for any reason.

Your obligations 

You must not, directly or indirectly

• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, object code, or underlying structure, ideas, know-how, or algorithms relevant to any Game or any software, documentation, or data related to such Game (“Software”).
• Modify, translate, or create derivative works based on the Games or any Software.
• Access all or any part of the Game or the Software in order to build a product or service which competes with any Game.
• Use the Games to provide services to third parties.
• Use the Games in a manner that is illegal or causes damage or injury to any person or property.
• Store, distribute, or use malware or any unlawful, harmful, threatening, defamatory, obscene, infringing, harassing, racially, or ethnically offensive materials during your use of any Game.
• Use the Games to promote unlawful violence or discriminate based on race, gender, color, religious belief, sexual orientation, or disability.
• Attempt to obtain, or assist third parties in obtaining access to any Game.

Communications

By creating an account in any of our Games, you agree to subscribe to newsletters, marketing materials, and other information we may send. However, you may opt out of receiving any or all communications from us by following the unsubscribe link or instructions provided in any email we send.

Copyright Policy

Third party IP rights. We respect the intellectual property rights of others. It is our policy to respond to any claim that content posted in the Games infringes the copyright or other intellectual property rights of any person or entity.

Reporting copyright infringement. If you are a copyright owner, or authorized to act on behalf of a copyright owner, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide a detailed description of the alleged infringement in your notice. You may be liable for damages (including costs and attorneys’ fees) for misrepresentation or bad faith.

Intellectual Property 

Protection of intellectual property. The Game is protected by copyright, trademark, and other laws around the world. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Ownership and exclusive property. Each Game and all of its original content, features, and functionality, including but not limited to any text, graphics, images, software, website layout, and any improvements or modifications made to the Games, are and will remain the exclusive property of the Games’ owner and its licensors.

License. We grant you a limited, non-exclusive, non-transferable license to access and use the Games solely for personal, non-commercial purposes in accordance with these Terms.

Restrictions on use. You agree not to reproduce, modify, distribute, sell, lease, rent, transmit, broadcast, publicly display, create derivative works based on, or exploit for any commercial purposes any portion of the Games, except as expressly authorized by us in writing.

Links to Other Sites

Our Games may contain links to other websites that we do not operate. 

We do not control and are not responsible for the content, terms of use, privacy policies or practices of any third party websites or services. We strongly encourage you to review the terms of use of each site you visit.

Termination 

At-will termination. You may terminate or suspend your account at any time by contacting us at contact@rovetek.com.

Upon termination, we will remove your personal information from our databases, except as otherwise specified in our Privacy Policy, required by law, or as necessary to enforce our rights or resolve disputes.

Forced termination. We reserve the right to terminate or suspend your account without notice to you if we reasonably determine, that:

• you have breached any part of these Terms;
• it would be in the best interests of our community or any Game, or is required for upholding a third party’s rights;
• you have made unauthorized use of someone else’s payment info.

We may terminate your account with notice in advance if we stop offering our services in your region. 

If you think that we have made a mistake, please contact us with details, and we will review your case. 

Effect of termination. If your account is terminated, you’ll no longer have access to your account, including any of the associated data or Virtual items. 

Non-using. If you do not use your account for a long time, We may take measures that may include suspension or termination with prior notice.

Indemnification 

By downloading our Games, you agree to protect and defend us, our licensee, and licensors, as well as their employees, contractors, agents, officers, and directors from any claims, damages, obligations, losses, liabilities, costs, or expenses, including attorney’s fees, that may arise from or be related to your use of our Games or any breach of these Terms.

We will notify you of any such claims but reserve the right to assume the exclusive defense and control of any matter subject to your indemnification.

Limitation Of Liability and Disclaimers 

Limitation of liability. We, our directors, employees, partners, agents, suppliers, or affiliates will not be held responsible for any indirect, incidental, special, consequential, or punitive damages. This includes losses such as profits, data, use, goodwill, or intangible losses that may occur due to

• your access to or use of any Game, or your inability to access or use it;
• conduct or content of any third party within the Games;
• content obtained from the Games;
• unauthorized access, use, or alteration of your transmissions or content.

This applies regardless of the legal theory, whether it is a breach of warranty, contract, or negligence, and regardless of whether we were informed about the possibility of such damages. 

No Guarantees or Warranties. We strive to provide you with high-quality Games that meet your expectations, but please note that Games are provided on an “as is” and “as available” basis. Furthermore, we, our subsidiaries, affiliates, and licensors cannot guarantee that:

• the Game will function uninterrupted, be secure, or be available at any particular time or location;
• any errors or defects will be corrected;
• the Games are free of viruses or other harmful components; or
• the results of using the Game will absolutely meet your requirements.

Ongoing support. We want to be transparent about these limitations and ask that you use the Games at your own risk. However, we will do our best to promptly address any issues and make necessary improvements to enhance your user experience. Exclusions 

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.

Miscellaneous 

Governing law and jurisdiction. These Terms must be governed and construed under the laws of Germany.

Non-Waiver of Rights. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. 

Severability of Terms. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. 

Entire Agreement. These Terms constitute the entire agreement between us regarding our Games, and supersede and replace any prior agreements we might have had between us regarding the Games.

Changes 

We may update our Terms of Use from time to time. We will inform you about updates via email or a prominent notice on our website before the changes become effective.

Changes to these Terms of Use become effective when they are posted on this page.
